JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-07-2020 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of COVID-19 Pandemic. The present petition has been filed for restoration of a petition bearing Cr. Rev. no. 838 of 2019, which has stood dismissed on account of non-compliance of the peremptory order dated 06.01.2020, whereby and whereunder the petitioner was granted four weeks' peremptory time for removal of the defects, however within the aforesaid time limit, the petitioner had failed to remove the defects.
The learned counsel for the petitioner has submitted that on account of the counsel for the petitioner
Patna High Court CR. MISC. No.15788 of 2020(2) dt.08-07-2020 2/2 having met with an accident, the defects could not be removed within the peremptory time granted by this Court, however it is submitted that there is no wilfull or deliberate delay on the part of the petitioner in not removing the defects. Having regard to the facts and circumstances of the case, I deem it fit and appropriate to restore the aforesaid petition bearing Cr. Rev. no. 838 of 2019 to its original file, subject to the petitioner removing all the defects, pointed out by the office within a period of six months from today. The petition stands allowed on the aforesaid terms. (Mohit Kumar Shah, J) rinkee/- U T
