JUSTICE PRABHAT KUMAR JHA ORAL ORDER 15-07-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as the informant. The petitioner apprehends his arrest in Complaint Case No. 34 of 2015 registered for the offences punishable under Sections-406 and 420 of the Indian Penal Code. Learned counsel for the complainant alleged that the petitioner borrowed Rs.60,000/- on the assurance to return the same by 01.03.2013, but the petitioner did not return the money. It is submitted that the petitioner has not received any money from the complainant.
Considering the facts that the dispute arose due to lending of money, the petitioner above named, in the event of his
Patna High Court Cr.Misc. No.17465 of 2016 (3) dt.15-07-2016 2/2 arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Sasaram, Rohtas in connection with Complaint Case No. 34 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
