The petitioner, apprehending his arrest in connection with Bihar Excise Case No. 28 of 2013 registered for the offences punishable under Sections 47 (a) & (f) of the Bihar Excise Act, seeks the privilege of pre-arrest bail.
Huge quantity of country-made liquor was recovered from the house of Kamlesh Singh and the petitioner's name has come in the confessional statement of co-accused made before the Police.
Submission is that in this case other co-accused have been allowed pre-arrest bail vide Annexure-2 series by another Bench of this Court and as such, the petitioner having no criminal
Patna High Court Cr.Misc. No.29144 of 2014 (3) dt.12-01-2015 antecedent also deserves sympathetic consideration. Considering that Amresh Singh has been allowed pre-arrest bail vide Cr. Misc. No. 20626 of 2013 whereas Binod Rai @ Binod Kumar Rai has been allowed pre-arrest bail vide Cr. Misc. Case No. 8207 of 2014 and as the petitioner has also got no criminal antecedent and, as such, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of the copy of this order, shall be enlarged on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Samastipur in connection with Bihar Excise Case No. 28 of 2013, subject to the conditions as laid down under Section 438(2) Cr.
