Earlier prayer for bail has been rejected vide order dated 08.04.2017 in Cr. Misc. No. 16891 of 2017, vide Annexure1 with direction that Trial Court expedite the trial within six months.
Submission of the learned counsel for the petitioner is that six months has already expired and trial has not been concluded and his name disclosed by another person and till date no T.I.P. has been made and the petitioner is in custody since 11.01.2017. . Learned A.P.P also opposes the prayer for bail. Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.45421 of 2017 (3) dt.22-11-2017 2/2 circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Balthar P.S.Case No. 78 of 2016 with the following conditions that one of the bailors of the petitioner shall be a local person and the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and in future, prosecution is free to move for cancellation of his bail bonds.
