The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341/323/324/354/34 of the Indian Penal Code.
It is alleged that petitioner no.1, being brother-in-law of the informant caused bite injury on the breast of the informant and petitioner no.2, assaulted with 'daab' causing injury on the head of the informant whereas co-accused Laxmi Devi assaulted by catching hair of the informant. It is submitted by learned counsel for the petitioners that that petitioners are family members of the informant and in the background of share distribution of the rooms the accusation has been levelled. Patna High Court Cr.Misc. No.22520 of 2015 (2) dt.22-05-2015 2/2 informant is simple superficial in nature. There is counter version of the occurrence also and the petitioners' side also received injuries. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Sonepur P.S. Case No. 261 of 2014, pending before the learned Chief Judicial Magistrate, Saran at Chapra.
With the above observation, this application is, accordingly, disposed off.
