The petitioners apprehend their arrest in Pirpainty P.S. Case No. 337/15 registered under Section 394 of the Indian Penal Code.
The informant alleged that the petitioners were driver and cleaner of the truck but they were removed from service. While the informant was going with his truck, the petitioners signaled the driver to stop and thereafter both the petitioners committed robbery. Rupees one lac fourteen thousands and mobiles were looted away. Learned counsel for the petitioners submits that the petitioners were employees of the informant but they left the service of the informant, that is why, they have falsely been implicated in the case.
Patna High Court Cr.Misc. No.16539 of 2016 (4) dt.04-07-2016 2/2 It appears that the informant made specific allegation about the robbery committed by the petitioners on account of enmity. During the course of investigation, one Saddam Alam and Alim Khan stated that the petitioners committed robbery. Considering the facts aforesaid and the specific allegation made against the petitioners, I am not inclined to enlarge the petitioners on anticipatory bail in Pirpainti P.S. Case No. 337/15. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Dilip/- U T
