The petitioner seeks bail in a case instituted under Sections 379 and 411 of the I.P.C.

The prosecution case, in short, is that motorcycle of the informant bearing registration No. JH04C/3046 was stolen by some unknown miscreants.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.01.2017 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. Except for the confessional statement of the petitioner, there is no other substantive evidence to suggest his implication in the presnet

On behalf of the State, it is submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. case No.53 of 2017.
