The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
The prosecution case, in short, is that while the son of the informant was going to betel shop by motorcycle, the accused persons intercepted him. They started abusing and thereafter, dagger blow was given to the informant's son as a result of which, he sustained injuries. It is further alleged that Rs. 17,000/- was snatched away by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no
Patna High Court CR. MISC. No.15433 of 2020(2) dt.03-03-2020 2/2 allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-12-2019. Charge sheet in this case has already been submitted. The petitioner has been falsely implicated in the present case. There is case and counter case between the parties. The injury on the side of the accused has not been explained by the prosecution. The petitioner is said to have given single knife blow upon the victim. No repetition has been made. It has further been submitted that the petitioner may be released after completion of five months in custody.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that after completion of five months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 1188 of 2019.
