The petitioner seeks bail in connection with Udwantnagar P.S. Case No. 243 of 2019, registered under Sections 30(a) and 30(D) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

On receiving secret information about selling the liquor inside of canal in village Bhagwatipur, the informant, along with other police personnel, reached there. On seeing the police party, persons, present there, started to flee away, but, on chase, two persons were apprehended, who disclosed their names Kamakhya Yadav and Shiv Mangal Singh, from there 50 liters country made liquor, pipes and parts for preparing the liquor were recovered.

At that time, Chowkidar identified 26 persons, including the petitioner, who

Submission is that in fact, the petitioner is accused in Pawana P.S. Case No. 20 of 2015 of similar nature, due to that reason the police managed to implicate the petitioner. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Udwantnagar P.S. Case No. 243 of 2019 to the satisfaction of the Additional Sessions Judge IV-cum-Special Judge, Excise, Bhojpur at Ara.
