2. The petitioner has preferred this application for grant of regular bail in connection with Kochadhaman P.S. Case No. 21 of 2025 registered for the offences punishable under Sections 319(2), 318(4), 308(2), 308(3), and 308(5) of the Indian Penal Code.

3. As per the prosecution story, it is alleged that the petitioner and the co-accused persons were indulged in extorting money illegally from the vehicles passing on the road impersonating themselves as police officials.

Learned counsel for the petitioner submits that the petitioner is innocent, committed no offence and has falsely been implicated in this case due to ulterior motive and only on the basis of suspicion. On the alleged date and time of the occurrence, petitioner was passing through the place of occurrence and on the basis of suspicion, the police has remanded him in this case. Petitioner has clean antecedent.

5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

6. During course of argument, learned counsel for the petitioner submits that there is nothing incriminating article has been recovered from the conscious possession of the petitioner and he is in custody since 13.01.2025. One of the co-accused namely, Santosh Kumar has been granted regular bail from the co-ordinate Bench of this Court vide order dated 22.03.2025 in Cr. Misc. No. 14734 of 2025.Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kochadhaman P.S. Case No. 21 of 2025.
