JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 328 and 307 of the Indian Penal Code.
The prosecution case is that the grand son of the informant namely Ranjay Kumar went to watch paddy crops along with Bhola Kumar, Jittu Kumar and Chandan Kumar, thereafter at 9 P.M. in the night the grant son of the informant started vomiting. On being asked, he suggested that he was given some sweets by the petitioner to eat at 5 P.M. Thereafter, the grand son of the informant was taken to hospital when it was suspected that some toxic material was consumed by him.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.22253 of 2015 (2) dt.21-05-2015 2/2 that even the accusation suggests that simply it is a case of food poisoning. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the suspicious nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Rajauli P.S. Case No. 182 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
