1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Learned A.P.P, at the outset, submits that Cr. Misc. No. 51893 of 2023 was filed seeking anticipatory bail in a case registered under Sections 147, 148, 149, 212, 216, 307 and 353 of the I.P.C. and u/s 25(1-B) 9, 26, 27 and 35 of the Arms Act, and u/s 17 of the C.L.A. Act and the case stood dismissed for non prosecution by an order dated 9.02.2024. It is further submitted that the instant Restoration Application has been filed for restoring Cr. Misc.No. 51893 of 2023. It is also submitted that the petitioner in the year 2023 has moved this Court seeking anticipatory bail in a case registered in the year 2003 which amply demonstrates that leisurely petitioner was moving
Patna High Court CR. MISC. No.30914 of 2024(2) dt.20-04-2024 2/2 seeking his remedies available in Court. It is further submitted no useful purpose would be served by restoring Cr. Misc. No. 51893 of 2023 to its original file. Learned counsel for the petitioner is not in a position to rebut the submission of the learned A.P.P. that the F.I.R. was instituted in the year 2003.
3. Considering the submissions made by the learned A.P.P., the Court is not inclined to allow the Restoration Application.
4. Accordingly, the Restoration Application is dismissed.
