JUSTICE RAKESH KUMAR ORAL ORDER 09-05-2018 The sole petitioner, apprehending his arrest in connection with Pirbahore P.S. Case No. 466 of 2017, registered for the offence under Sections 406, 379 , 419 of the Indian Penal Code, 1860 , has prayed for grant of bail in the event of his arrest or surrender primarily on the ground that one of the co-accused in similar situation has been granted bail on 06.04.2018 vide Cr. Misc. No. 13752 of 2018.

On perusal of the F.I.R. it appears that dispute was in between tenant and landlord and in such dispute criminal case has been instituted.

Considering the fact that one of the co-accused in similar circumstances has been extended the privilege of anticipatory bail , there is no reason to refuse the same relief to the petitioner. Accordingly, in the event of his arrest or

No.27976 of 2018(2) dt.09-05-2018 2/2 surrender within a period of eight weeks from today , let petitioner namely Vijay Kumar Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna / concerned court in connection with Pirbahore P.S. Case No. 466 of 2017 subject to the conditions as contemplated under Section 438(2) of the Cr.P.C.
