JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Patori P.S. Case No. 06 of 2017 registered under Section 20(B) of the N.D.P.S. Act. 11 Kg of gnaja is said to have been recovered from beneath the bed of the room of the petitioner. It is submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from the conscious physical possession of the petitioner rather from the room which is said to be of the petitioner, but the petitioner is not residing in the said room. The seized ganja is less than the commercial quantity. The petitioner has been languishing in custody since 15.04.2017.

Considering the recovery of the aforesaid quantity

Patna High Court Cr.Misc. No.37998 of 2017 (2) dt.10-08-2017 2/2 of contraband from the room of the petitioner, I am not inclined to enlarge the petitioner on bail. His prayer for bail is rejected. However, learned trial court is directed to conclude the trial as expeditiously as possible within six months from the date of receipt or production of a copy of this order.
