2. The report dated 19.04.2024 is taken on record.
3. The petitioners seek bail in connection with Chandi P.S. Case No. 73 of 2023 registered for the offence punishable under Sections 147, 148, 149, 323, 336, 337, 338, 326, 307, 302, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
4. Pursuant to the last order, the case has been committed and the trial is now pending in the Court of Additional Sessions Judge-8th, Bhojpur at Ara.
5. Forteen persons are said to have fired upon the
Patna High Court CR. MISC. No.17814 of 2024(4) dt.03-05-2024 2/2 victim. The petitioners are named in the FIR. They are in custody since 18.03.2023. Learned counsel further submits that a co-ordinate Bench of this Court vide order dated 14.03.2024 in Cr. Misc. No. 17564 of 2024 has granted bail to a similarly situated co-accused namely, Satish Kumar Singh @ Sadish Kumar Yadav.
6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioners.
7. Considering the delay in trial and the period of custody, this application is allowed.
8. Let the petitioners, above named, be released on bail, after framing of charge if charge has not already been framed, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Chandi P.S. Case No. 73 of 2023, subject to the conditions that the petitioners will co-operate in the trial. They will appear personally or through their lawyer regularly. (Sandeep Kumar, J) P. Kumar U T
