JUSTICE ARUN KUMAR ORAL ORDER 18-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Aurangabad Town PS Case No. 86 of 2011 registered under Sections 406, 420, 467, 468 and 120B of the IPC.

The allegation in brief is that the complainant had taken policy in the name of his family members total of Rs. 56,000/- and after a decade the maturity amount was not paid by Bibhuti Insurance Marketing Private Limited OCPL Pvt. Limited and it is also alleged that the complainant was advisor of OCPL Company and by fraud the company has cheated Rs. 1,45,000/- Learned Counsel for the petitioner submits that the petitioner is not concerned with the Bibhuti Insurance Market Private Limited, there is no allegation in the complaint that what role in what capacity was played by the petitioner, moreover the petitioner has clean antecedent and other co-accused persons similarly situated have been admitted to bail by other coordinate Benches of this Court. Having considered the said facts and circumstances, the petitioner, namely, Dhiraj Prasad @ Dhiraj Kumar Prasad is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Aurangabad in connection with Aurangabad Town PS Case No. 86 of 2011.
