The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and informant alleges that on 05.03.2019 at about 7:30 PM, when his son was coming to his house when he was intercepted by 5-10 accused persons who assaulted him and thereafter the informant took his son to the hospital, it is next alleged that co-accused Sumit and Pappu were main assailants and rest were unknown to the informant.
Learned counsel for the petitioner submits that the

No.16622 of 2022(2) dt.21-09-2022 2/2 petitioner is innocent and has been falsely implicated in the present case, it is next submitted that petitioner is not named in the FIR and he came to be implicated as he is friend of the younger brother of the petitioner, it is also submitted that there is no injury on record. Learned counsel next submits that as far as allegation of assault is alleged the same specifically is against Sumit and Pappu.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Rupaspur P.S. Case No. 115 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
