This application, for grant of anticipatory bail, arises out of Ara (Mufassil) P.S. Case No. 210 of 2015, disclosing offences under Sections 109 and 307/34 of the Indian Penal Code.
From the First Information Report, it appears that the victim had attempted to commit suicide, allegedly, because of physical and mental torture caused by petitioner no. 1 and petitioner no. 2. The petitioner No. 2 is the sister of the husband of the victim whereas petitioner no.1 is the father-in-law of
Patna High Court Cr.Misc. No.17821 of 2016 (3) dt.12-07-2016 2/2 petitioner no. 2.
Learned counsel for the petitioners has submitted that though the victim succumbed to the injury subsequently, so far the implication of these petitioners are concerned, the same are baseless. He has submitted that there is a vague allegation against petitioner no. 1 of assaulting the victim. Considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above-named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, in connection with Ara (Mufassil) P.S. Case No. 210 of 2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
