JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Buxar (Town) P.S. Case 306 of 2017 instituted for the offence under Sections 406, 420, 467, 468, 471, 472 and 120(B)/34 of the Indian Penal Code. It is alleged in the written report that informant was told by this petitioner that his relative Sandeep Singh posted as A.G.M. in Damodar Valley Corporation, has appointed so many persons in the company. The appointment of son of the informant could also be made after making payment of Rs.3,00,000/- from each candidate. Thereafter, petitioner with two other accused persons namely, Sandeep Singh and Kedar Singh, handed over the appointment letter to the son of the informant and brother-inlaw of the son of the informant, which were found to be forged. Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.37868 of 2017 (2) dt.09-08-2017 2/2 no money was paid to the petitioner by the informant. From the allegation in the written report itself it appears that there is no any specific allegation against this petitioner that he has taken money from the informant on pretext of giving appointment letter to his son. The main allegation of taking money is against Sandeep Kumar who is posted in Damodar Valley Corporation.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (T) P.S. Case No. 306 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
