JUSTICE ARUN KUMAR ORAL ORDER 20-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 21.3.2018 seeks bail in Complaint Case No. 149C of 2011 registered under Sections 376, 504, 448, 380 and 341 of the IPC.

Learned Counsel for the petitioner submits that the prosecutrix and the petitioner are next door neighbours, due to neighbour dispute she has falsely implicated the petitioner, the prosecutrix is a married lady of middle age having six children, no alarm was raised, she says that she was sleeping with her children and husband and she is in habit of filing false cases against other covillagers. Having considered the said facts and circumstances, the petitioner, namely, Krishna Das is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri M.K.Pandey, Judicial Magistrate, lst Class, Jamui in connection with Complaint Case No. 149C of 2011.
