JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-07-2017 The petitioner seeks bail in connection with Simri P.S. Case No. 175 of 2016 registered for the offences punishable under section 392 of the Indian Penal Code.
Allegation against the petitioner is that informant has licensee S.B.B.L gun. The two persons came and, on the point of rifle looted his said gun and fled away.
Learned counsel for the petitioner submitted that he is not named in the FIR, his name was appeared only on the basis of confession and on criminal antecedent. The petitioner has been in custody since 18.02.2017.
Heard learned A.P.P. also.
Having heard both sides, in view of the confession as well as the antecedent of the petitioner, I am not
Patna High Court Cr.Misc. No.34511 of 2017 (2) dt.27-07-2017 inclined to grant bail to the petitioner. However, learned Additional Chief Judicial Magistate-IV, Buxar, is directed to conclude the trial of the petitioner within a period of six months. In case the trial is not concluded within the said period, the appellant would be at liberty to renew his prayer for bail.
With the above observation, this application is dismissed.
