JUSTICE ARUN KUMAR ORAL ORDER 18-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.3.2018, seeks bail in Khizarsarai PS Case No. 76 of 2018 registered under Section 376 of the IPC.

Learned Counsel for the petitioner submits that though in the FIR there is allegation of committing rape to the prosecutrix but in her statement recorded under Section 164 Cr.P.C. she has denied that any rape was committed to her and only stated about outraging her modesty, further it is submitted that the petitioner lives in the neighbour hood and due to petty dispute he has falsely been implicated.

Having considered the said facts and circumstances, the petitioner, namely, Md. Ali Ansari @ Nanhak Ansari @ Md. Ali Hussain @ Ali Husain Miya @ Ali Ansari @ Nanhak is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VII Gaya in connection with Khizersarai PS Case No. 76 of 2018.
