Petitioners apprehend their arrest in a case registered for the offences punishable under Section 379/411 of the Indian Penal Code.

Informant with the help of other villagers caught one Shiv Ratan Bind on the allegation of committing theft of his buffalo. Petitioners' name has been taken by the said accused person as his aide, who fled away from the place of occurrence. Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case because of their inimical terms with the said co-accused. Petitioners have got no criminal antecedent and no buffalo has been recovered from their possession. On the date of

Patna High Court CR. MISC. No.16178 of 2020(2) dt.03-09-2020 2/2 occurrence, petitioners were in fact residing in Ludhiana for earning their livelihood.

Considering the facts of the case, let the petitioners named above, in the event of surrender before the Court below within six weeks from the date of receipt of this order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 1, Patna City, Patna in Gaurichak Police Station Case No.15/2020, subject to the conditions laid down under sections 438 of the Code of Criminal Procedure.
