The petitioners, apprehending their arrest in Akangar Sarai P.S. Case No. 190 of 2013 registered for the offences punishable under Sections 341, 323, 504, 419, 420, 406 and 468/34 of the Indian Penal Code, seek the privilege of the prearrest bail. Allegedly, from the informant co-accused Birendra Kumar Yadav took Rs. 3,00,000/- to provide job in Azad News Channel and the petitioners also gave assurance in Hotel Maurya. Submission is that no amount has been paid to the
Patna High Court Cr.Misc. No.27511 of 2014 (3) dt.07-01-2015 petitioners and only allegation against Rajeev Upadhyaya is that he was also instrumental and was aiding Birendra Kumar Yadav to which the learned Additional Public Prosecutor fairly concedes. In the facts and circumstances stated above, the petitioners, above-named, are directed to be released on anticipatory bail in the event of their arrest or surrender within one month from the date of receipt/production of a copy of this order on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, District Nalanda in connection with Akangar Sarai P.S. Case No. 190 of 2013, District Nalanda, subject to the condition as laid down under Section 438(2) Cr. P.C.
