The petitioner apprehends his arrest in connection with Barachatti P.S. Case No. 460 of 2016 for the offences punishable under Sections 272, 273, 279, 120(B) of the Indian Penal Code and under Sections 30(a), 32(2), 38 and 47 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed the offences as alleged in the F.I.R. and in fact, he has falsely been implicated in this case for his no fault. Nothing has bee recovered from the conscious possession of this petitioner. Petitioner was not aware about the alleged liquor

Learned APP appearing for the State opposes the prayer for bail and submits that huge quantity of illicit liquor has been recovered from the vehicle of this petitioner. Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail of this petitioner. Accordingly, the prayer for grant of anticipatory bail is hereby rejected.
