The petitioner seeks bail in Chousa P.S. Case No. 10/2017, registered for the offences punishable under Sections 25(1-B)A, 26/35 of the Arms Act.

The case of the prosecution is that the police was checking vehicles for recovery of illegal arms and liquor. In course of checking of vehicles, two persons, riding on a TVS motorcycle, were apprehended and so far as the petitioner is concerned, two country made pistol and live cartridges were recovered.

Learned counsel for the petitioner submits that other accused, who was apprehended along with the petitioner by the police, has already been granted bail by this Court. It is further submitted that the petitioner is languishing in custody since

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail immediately upon completion of nine months in custody.

Accordingly, it is directed that the petitioner may be released on regular bail upon completion of nine months from 12.01.2017, upon such conditions as may be imposed by the learned trial court.

The petition is disposed of.
