Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 304(B),201/34 of the Indian Penal Code.
The petitioner is brother-in-law of the victim of dowry death.
Submission is that husband is already in custody and the allegation is general and omnibus. Petitioner is in custody since 13.12.2017. Investigation of the case is already
Patna High Court Cr.Misc. No.30077 of 2018(2) dt.22-05-2018 2/2 complete and the petitioner is ready to cooperate with the trial. It is further submitted that similarly situated co-accused persons have already been granted by this Court by an order dated 13.03.2018 passed in Criminal Miscellaneous No. 14347 of 2018 and order dated 10.04.2018 passed in Criminal Miscellaneous No. 19258 of 2018.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Semra Police Station Case No. 166 of 2017 arising out of S.Tr. No. 251 of 2018, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
