JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-09-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other family members caused death of daughter of informant. It is submitted on behalf of petitioner that petitioner is mother-in-law of deceased and has got no concern with the affairs of the deceased. In fact, she caught fire while she was cooking and in spite of steps taken to save her life, she could not be saved. In this case, surprisingly, husband of the deceased has not been made accused which itself casts serious doubt about the veracity of the prosecution case. The family members of deceased took part in funeral of deceased and in their presence, she was cremated and as such, no case under Section 304(B) of the I.P.C. is made out against petitioner.

No.16551 of 2022(5) dt.22-09-2022 2/2 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Sahiyara Police Station Case No. 127/2020, subject to the conditions laid down under section 438 of the Code of Criminal Procedure.
