Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code.

It is alleged that Surendra Ray, Yogendra Ray, Niraj Ray(petitioner), Birendra Ray, Munna Ray(petitioner) came and resorted to fire causing fire arm injury on the abdomen of the aunt of the informant who subsequently succumbed to the injuries.

It is submitted by learned counsel for the petitioners that in the background of admitted enmity the accusation has been levelled when the accusation of firing is omnibus and general and the postmortem reflects only one injury.

A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.21925 of 2015 (2) dt.24-06-2015 2/2 petition that petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of regular bail, if the petitioners surrender within a period of six weeks in connection with Shahpur P.S. Case No. 236 of 2014, pending in the Court of learned Chief Judicial Magistrate, Bhojpur, Ara.

With the observations above, the application stands disposed off.
