JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, who is in custody since 24.01.2020, seeks bail in connection with Pirpainti P.S. Case No. 23/2020, dated 23.01.2020, instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The petitioner is alleged to have been carrying 65 litres of liquor on the motorcycle which he was driving. Learned counsel for the petitioner submits that he has falsely been implicated in this case which is evident from the fact that there is no signature of his on the

Patna High Court CR. MISC. No.14181 of 2020(2) dt.03-03-2020 2/2 seizure list.

Regard being had to the fact that petitioner has a clean antecedents and is in jail since 24.01.2020, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge (Excise Act) Bhagalpur in connection with Pirpainti P.S. Case No. 23/2020.

The application stands allowed.
