JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 At the outset, it is submitted that this application has already been withdrawn so far as it relates to petitioner no. 1 Jaiprakash Singh.
Heard learned counsels for the petitioners, informant and the State.
The petitioner nos. 2 and 3 are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307,384,379,504 and 506/34 of the Indian Penal Code and section 27 of the Arms Act.
The accusation is of demanding extortion and assaulting the informant's son and others.
Patna High Court Cr.Misc. No.31752 of 2014 (3) dt.05-02-2015 2/2 It is submitted by learned counsel for the petitioners that the ionjury has been found to be simple when the petitioners' side filed Sour Bazar P.S. Case No. 367 of 2013 at earlier point of time. It is further submitted that co accused Bambam Singh has been granted anticipatory bail vide Cr Misc. No. 8756 of 2014. Statement has been made in paragraph 3 that petitioner no. 3 is accused in one other case.
Considering the aforesaid facts, let the above named petitioner nos. 2 and 3 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Sourbazar P.S. Case No.369 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
