JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2017 Heard Sri Ranjeet Kumar Mishra, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 13.07.2017 in Parsauni P.S. Case no.51/2017 registered for the offence under Sections 272, 273/34 of the Indian Penal Code and under Sections-30(A)/ 38(i) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner is having clean antecedent, which has been stated in paragraph-3 of the petition. He submits that the petitioner was not at all aware of carrying of about 15 liters 120 ml of Indian Make Foreign Liquor in a Maruti Suzuki Van and only on suspicion, he has been made accused. He submits that the petitioner is a labourer.

No.39457 of 2017 (2) dt.19-08-2017 2/2 Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner, namely, Ashish Sharma be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned I/C AD.J.II-cum- Special Judge, Excise Act, Sitamarhi in connection with Parsauni P.S. Case no.51 of 2017.
