JUSTICE ARUN KUMAR ORAL ORDER 14-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 26.2.2018, seeks bail in Rajpur PS Case No. 31 of 2018 registered under Sections 341, 302, 504/34, 120B of the IPC and Section 27 of the Arms Act. The allegation in brief is that the informant and his father were returning back to his home then on the way four FIR named accused persons and others stopped them, Munna Rajbhar shot at the informant's father causing his death.

Learned Counsel for the petitioner submits that there is no specific allegation against the petitioner of killing the deceased rather the same is against one Munna Rajbhar who shot at him, moreover similarly situated another co-accused Ramniwash Rajbhar has been admitted to bail by this Court and this petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Daroga Ray is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VII, Buxar in connection with Rajpur PS Case No. 31 of 2018.
