26-06-2018 Heard Sri Vinod Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Rampur P.S. Case No. 107 of 2017 registered for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender, primarily on the ground that save and except suspicion and confessional statement of the co-accused, there is no other material to connect the petitioner in the present case.
Learned counsel for the petitioner has drawn my attention to statement made in paragraph 3 of the petition to show that petitioner is having clean antecedent and in this case from possession of co-accused, only 1 litre & 80 ml. of foreign liquor was shown to be recovered.

No.30968 of 2018(3) dt.26-06-2018 2/2 Considering the nature of accusation, clean antecedent as well as the fact that petitioner has been made accused on confessional statement of the co-accused, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Lalla @ Roushan Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Gaya in connection with Rampur P.S.
