JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-08-2017 The petitioner seeks regular bail in connection with Mohiuddinnagar P.S. Case No. 45 of 2017, registered for offences punishable under Sections 8/20(b) (11)B/25/29 of NDPS Act. Allegation against the petitioner is of recovery of 9.8 kilograms of Ganja from his Gumti.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and he has no criminal antecedent and has been in judicial custody since 06.03.2017. Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case and quantity of recovery of Ganja, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
