Petitioner, already in custody, seeks bail in connection with Daudnagar PS Case No.66 of 2018, registered under Sections 341/323/504 of the Indian Penal Code as well as under Section 8 of the POCSO Act.
Allegation is that the petitioner was dragging away the daughter of the informant from his house in a nearby field, when the villagers identified him then he left the girl and escaped away.
Learned counsel for the petitioner submits that the allegation against the petitioner is patently absurd that a girl was being dragged from the house and no one objected, moreover there is no explanation that why the case was instituted after
Patna High Court Cr.Misc. No.29892 of 2018(2) dt.15-05-2018 2/2 four days of the alleged occurrence, the petitioner lives in the neighbourhood of the informant and due to some dispute, he has falsely been implicated and the petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstances, petitioner Manoj Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judgecum-Special Judge (POCSO), Aurangabad in connection with Daudnagar PS Case No.66 of 2018.
