JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Branch Manger of Bank of Baroda is apprehending arrest in a case registered for the offences punishable under Sections 420/467/468/471/34 of the Indian Penal Code.

Learned counsel for the petitioner is permitted to make necessary correction in the address of petitioner. It is alleged against the petitioner that the petitioner being bank manager sanctioned housing loan of Rs. six lacks on the basis of forged four gift deeds.

It is submitted by learned counsel for the petitioner that the petitioner sanctioned the loan on the basis of verification report and opinion of Bank's advocate, the opinion of the advocate has been brought on record as annexure - 2. Moreover, the loanee has been

Patna High Court Cr.Misc. No.22031 of 2015 (2) dt.21-05-2015 2/2 granted anticipatory bail vide Criminal Miscellaneous No. 41653 of 2014 on the undertaking that he is ready to liquidate the entire loan amount of Rs. six lacs. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Mansahi P.S. Case No.53 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
