Petitioner seeks bail in Runnisaidpur P.S. Case No.153 of 2015 instituted for the offence under Section(s) 394 Indian Penal Code.

Petitioner is not named in the First Information Report.

It is alleged in the written report that some unknown persons snatched the motorcycle of the informant. Counsel for the petitioner has submitted that no TIP has been held. The petitioner was earlier arrested in connection with Ahiyapur P.S. Case No.313 of 2015 with allegation that stolen motorcycle has been recovered from his possession. In that case, he has already been enlarged on bail by a co-ordinate Bench

Patna High Court Cr.Misc. No.37410 of 2017 (3) dt.06-09-2017 2/2 of this Court by order dated 02.11.2016 passed in Cr. Misc.No.31186 of 2016. Petitioner has been remanded in this case on 12.02.2017.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No.153 of 2015, subject to the condition that both the bailors shall be close relative of the petitioner.
