2. The petitioner has preferred this application for grant of regular bail in connection with Nawada Town P.S. Case No. 1374 of 2024, dated 20.11.2024 registered for the offences punishable under Sections 115(2), 126(2), 118(1), 109(2) and 352 read with Section 3(5) of the B.N.S., 2023.

3. As per the prosecution case, while the informant was going towards his home at Linepar Mirzapur Suraj Temple, he saw FIR named accused persons playing gambling and a verbal altercation took place between them, thereafter, the accused Sunil attacked the informant with pasuli due to which his neck was half cut and he sustained grievous injury and became unconscious.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.15944 of 2025(2) dt.19-04-2025 2/2 that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that as per allegation in the FIR, the petitioner has assaulted the informant with sharp edged weapon, however, the doctor has opined that injury is simple in nature. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 21.11.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition and submits that there is specific allegation against the petitioner that he has assaulted the informant with sharp edged weapon.

Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 1374 of 2024.

7. The application stands allowed.
