The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code.

The prosecution case is that on a suspected stolen motorcycle was recovered when Nagendra Kumar was apprehended who disclosed that the petitioner and others escaped from the scene.

It is submitted by learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner.

Patna High Court Cr.Misc. No.17543 of 2016 (2) dt.26-04-2016 2/2 A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Siwan Muffasil P.S. Case No. 465 of 2015 pending in the court of learned Chief Judicial Magistrate, Siwan.
