JUSTICE ARUN KUMAR ORAL ORDER 11-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 27.3.2018, seeks bail in Aurangabad Town PS Case No. 94 of 2018 registered under Sections 147, 148, 149, 504, 436, 427, 307, 160, 295A and 353 of the IPC. The allegation in brief is that on the occasion of Ram Nawmi procession was taken in the torn, some members of other religious community pelted stones causing communal disharmony. Learned Counsel for the petitioner submits that large number of people have been made accused but no specific overt against the petitioner, similarly situated other co-accused Om Prakash Singh has been admitted to bail vide Cr. Misc. No. 27303 of 2018, others have also been admitted to bail and the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Sumit Kumar Mishra @ Pappu Mishra is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Aurangabad in connection with Aurangabad Town PS Case No. 94 of 2018.
