Petitioner seeks bail in a case registered for the offences punishable under Sections 147,148,149,307,353 and 120B of the I.P.C., Section 25(1-B)26,27,35 of the Arms Act and Sections 16,17 and 20 of Unlawful Activities (Prevention) Act.
Submission is that the FIR would reveal that during combing operation against Naxal, firing and counter firing took place and one of the Naxals was apprehended by the police, who disclosed name of other co-culprits including Arun Yadav. Petitioner is not a Yadav, however, the police arrested the petitioner on the aforesaid material. Petitioner has stated on oath that he has got no criminal antecedent. He is in custody since
Patna High Court CR. MISC. No.14972 of 2020(2) dt.04-03-2020 2/2 03.11.2019. Investigation of the case is complete. There is no material to substantiate that petitioner is going to tamper with the evidence or hamper the trial.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Piri Bazar P.S. Case No.115 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case as well as the petitioner shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
