The petitioner seeks bail in connection with Pandaul P.S. Case No. 92 of 2017 registered under Sections 420, 406, 120(B), 504 and 467 of the Indian Penal Code. The petitioner who happens to be Sector Manager in Jyoti Shakha Credit Investment Company Ltd. and others are said to have appointed the informant as Loan Officer to collect money from public on the basis of commission. Accordingly, he deposited more than 6 lacs in the Pandaul Branch of the said company collecting the same from the public. But, the said Company did not repay money to the beneficiaries on its maturity despite request made by them and thus grabbed the aforesaid money of the beneficiaries.

Patna High Court Cr.Misc. No.54907 of 2017 (2) dt.15-12-2017 It is submitted by learned counsel for the petitioner that the allegation levelled against the petitioner is not specific rather omnibus. The petitioner happens to be Sector General Manager of the said Company and was also an employee of the said Company. After depositing the money by the Loan Officer, he sent the same to its Delhi office. He has not misused any money. Moreover, no any complain has been made against the petitioner by any beneficiary regarding misappropriation of his money. The petitioner has been languishing in custody since 22.07.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani, District-Madhubani in connection with Pandaul P.S.
