The petitioner is in custody since 08.01.2018 in connection with Janta Bazar P.S. Case No. 03 of 2018 for the offence registered under Sections 413 and 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the alleged recovery is not from his conscious possession and the motorcycle and key which were recovered from the same motorcycle belongs to one Nand Kishore Rai, who had purchased the same from Mithelesh Kumar Ray and the transfer application of the said motorcycle is pending before the D.T.O. Therefore, it is not a case of theft.

No.30340 of 2018 (2) dt.18-05-2018 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.- 1st Saran at Chapra in connection with Janta Bazar P.S. Case No. 3 of 2018.
