The petitioner is languishing in custody since 17.11.2018 in a case registered for the offences punishable under Sections 413 and 414 of the I.P.C.

The prosecution case as per the self-statement SI Amit Kumar-cum-SHO, Madhuban Police Station dated 16.11.2018 is to the effect he received a confidential information that some motorcycle lifters are arriving at Hardiya bridge from Fenhara to sell the stolen motorcycle. Thereafter the informant constituted a raiding team and reached at the spot when on seeing the police, they started fleeing but on chase, tey were apprehended who disclosed their names as co-accused Vijay Paswan and Ravindra Kumar ( the petitioner).

It is submitted by learned counsel for the petitioner that

Patna High Court CR. MISC. No.16217 of 2019(2) dt.15-03-2019 2/2 the petitioner was the pillion rider and he had no knowledge about the motorcycle being stolen one. Though the petitioner is accused in other cases but he is on bail in those cases. It is further submitted that other co-accused Vijay Paswan has been granted bail by a Bench of this Court vide order dated 8.3.2019 passed in Cr. Misc. No. 14082 of 2019.

Learned APP submits that the stolen motorcycle was recovered from the petitioner.

Considering the fact that similarly situated co-accused has been granted bail, the investigation has already been concluded and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-4, East Champaran in connection with Madhuban P.S. Case No. 245 of 2018. (Dinesh Kumar Singh, J) anil/- U
