The present writ application has been filed for the

Patna High Court CR. WJC No. 690 of 2023(2) dt.05-05-2023 2/2 purpose of proper investigation in connection with Kundwa Chainpur P.S. Case No. 172 of 2022 dated 03.09.2022 lodged under Sections 341/ 323/ 389/ 504/ 506/ 385/ 34 of the I.P.C. read with Section 27 of the Arms Act.

Counsel for the petitioner submits that petitioner is informant in this case.

Counsel for State submits that this case may be disposed off in the light of order passed in Surendra Singh Vs. The State of Bihar & Ors. in Cr. WJC. No. 153 of 2017 and analogous cases decided on 09.09.2022.

In this view of the matter, the present criminal writ petition is disposed off with direction to the petitioner to file representation before the Superintendent of Police, East Champaran at Motihari in the light of the order passed in Surendra Singh Vs. The State of Bihar & Ors. in Cr. WJC. No. 153 of 2017 with analogous cases decide on 09.09.2022 within four weeks' from today and the Superintendent of Police, East Champaran at Motihari shall consider the representation and take appropriate action.
