2. The petitioner apprehends arrest in connection with Lalganj PS Case No.374 of 2023 dated 27.10.2023, instituted under Sections 341, 323, 379, 354, 307, 325, 504, 506/34 of the Indian Penal Code.

3. The allegation against the petitioner is that he assaulted the informant on his head by means of sword. Coaccused, Nand Lal Sahani, also assaulted the informant on his head by means of iron rod. It is also alleged that the petitioner disrobed the wife of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Both sides are neighbours. Petitioner is a student, who is

It is further submitted that two injuries have been found on the person of the informant both caused by hard and blunt substance. There is no injury of any sharp cut weapon and, thus, the injury report does not support the allegation. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in Lalganj PS Case No.374 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
