ANJANA MISHRA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 323/354/504/447/34 of the Indian Penal Code and Section 3(i)(x)(xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Diary in this case was called for earlier which has since been received.

Learned counsel for the petitioner submits that out and out malicious allegations have been levelled against the petitioner and provisions of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 have been invoked only make the charge graver. It is further submitted that the petitioners have no concern

Patna High Court Cr.Misc. No.16033 of 2016 (3) dt.24-06-2016 P2/2 whatsoever with the victim lady or her family yet she is wrongly alleging against them.

Learned counsel appearing on behalf of the State submits that apart from the allegations made in the First Information Report, there is no further cogent material in the case dairy to connect this petitioner.

In view of the aforementioned facts and circumstance and that the petitioner has got no criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar, Motihari in connection with Muffasil P.S. Case No. 402/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
