The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147,148, 149,323,341,307 and 302 of the Indian Penal Code.

As per prosecution case, the allegation against the accused persons including the petitioner is that they armed with lathi danda and other articles came at the home of the informant and started assaulting due to which informant and his father sustained injuries and. During treatment his father died due to sustained injuries.

Patna High Court CR. MISC. No.25889 of 2023(3) dt.02-08-2023 2/3 Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous land dispute. There is no specific allegation of assaulting and committing murder of the informant lellved against the petitioner rather general and omnibus allegation levelled against him. He has got no criminal antecedent. Similarly situated co-accused persons have already been granted bail by this Court vide order dated 24.08.2022, passed in Cr. Misc. No. 68441 of 2021. It is further submitted that the petitioner is languishing in judicial custody since 10.07.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Mahnar P.S. Case No. 156 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
