JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2025 Heard Mr. Keshav Bhardwaj, learned counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 409, 420 and 511 of the Indian Penal Code.
3. As per prosecution case, informant, namely Ram Ahlad Mahto, who is posted as an Agriculture Coordinator in the District Agriculture Office, has alleged that this petitioner has fraudulently stolen his user-I.D. and password and by stealing the identity has attempted to embezzle Rs. 2,06,698/-.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has
Patna High Court CR. MISC. No.16983 of 2025(4) dt.03-07-2025 2/2 committed no offence. As a matter of fact, petitioner has falsely been implicated in this case with ulterior motive. Petitioner claims clean antecedents.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he has stolen the login-id and password of informant, who is a government servant and attempted to embezzle government money.
6. Considering the facts and circumstances of the case and gravity of offence, the prayer for grant of anticipatory bail to the petitioner is rejected.
